The planning application for five houses was recommended by officers for approval at planning committee and was overturned by Members. Following an Appeal under Reference APP/X1925/W/21/3269884 the planning inspectorate allowed the appeal subject to planning conditions.

Appeals
Reference – APP/U5360/D/9/3243235 Council – Hackney
Development – Excavation of a single-storey basement level beneath the front garden and footprint of property in association with the formation of a front lightwell and partial removal of the front boundary wall.
Conclusion – Appeal allowed, Planning inspector found the council’s perceived harm to the character of the street by inclusion of the basement was unfounded and not considered harmful.
Excavation of a basement with lightwells - Hackney

Development – Excavation of a single-storey basement level beneath the front garden and footprint of property in association with the formation of a front lightwell and partial removal of the front boundary wall.
Comment – Appeal allowed, Planning inspector found the council’s perceived harm to the character of the street by inclusion of the basement was unfounded and not considered harmful.
Excavation of a basement and rear extension - Hackney

Comment – Appeal allowed, Planning inspector found the biodiversity and quality of light and outlook to future occupiers would not be detrimentally harmed.

Development – LDC, lawful use and retention and formal regularisation of the three (3) self-contained units ar the ground floor of building 42 Lampard Grove
Conclusion – Appeal B is allowed and the existing use of three (3) was found to be Lawful by the appeal inspector.
Erection of five dwelling houses – North Hertfordshire

Development – Erection of five dwelling houses in association with a new access spur from the lodge Court, on-site parking, landscaping (inclusive of new trees), formation of a pedestrian footpath and designated communal open space.
Comment – Appeal allowed, the inspector considered the benefits of the development to clearly outweigh the substantial weight given to green Belt harm. I find that the other considerations in this case clearly outweigh the harm that I have identified.

Redevelopment of the site via the change of use from commercial (E class/Sui Generis) to residential, partial demolition of existing buildings on site and erection of two, two storey residential blocks with three floors of habitable space to facilitate the creation of eleven (11) units and three on-site parking spaces.
